Welcome to Garuda. These Terms of Use govern your access to and use of the website, mobile site, online store, customer support channels, digital services, and related platforms operated by Garuda International Electronics Private Limited. Throughout these Terms, the words "Garuda", "we", "us", and "our" refer to Garuda International Electronics Private Limited. The words "you", "your", "customer", and "user" refer to any person who visits, browses, registers, places an order, makes a payment, submits an enquiry, or otherwise uses our website or services.

By accessing or using our website, placing an order, creating an account, making a payment, requesting support, or using any Garuda service, you agree to be bound by these Terms of Use, along with our Privacy Policy, Shipping & Delivery Policy, Returns & Refunds Policy, Cancellation Policy, Warranty & Service Policy, and any other policy displayed on our website from time to time.

Please read these Terms carefully before using our website. If you do not agree with these Terms, you should not use our website or place an order through Garuda.

1. About Garuda

Garuda is a retail and commerce platform offering electronics, home appliances, furniture, gadgets, smart devices, accessories, lifestyle essentials, and related products and services for modern homes and everyday living. Our product categories may include smartphones, laptops, televisions, audio products, refrigerators, washing machines, air conditioners, kitchen appliances, water purifiers, smart home products, gaming accessories, office and study furniture, living room furniture, bedroom furniture, dining furniture, storage solutions, décor, and other lifestyle products.

Garuda may operate through online channels, retail outlets, assisted sales teams, delivery partners, installation teams, brand-authorised service centres, finance partners, and other third-party service providers. Some products and services may be fulfilled directly by Garuda, while others may be supported or fulfilled through manufacturers, brand partners, logistics providers, service agencies, or finance partners.

We aim to offer genuine products, transparent information, fair value, helpful guidance, dependable delivery support, and a comfortable shopping experience. However, product availability, pricing, offers, delivery timelines, installation timelines, warranty terms, and service availability may vary based on brand, category, stock, location, customer readiness, and serviceability.

2. Eligibility to Use the Website

You may use the Garuda website only if you are legally capable of entering into a binding contract under applicable law. By using the website or placing an order, you confirm that you are at least 18 years of age or are using the website under the supervision of a parent or legal guardian. If you are using the website on behalf of another person, family member, organisation, or entity, you confirm that you have the authority to do so and to bind such person or entity to these Terms.

Garuda reserves the right to refuse access, restrict account usage, cancel orders, block transactions, or decline services if we believe that the website is being used for unlawful, fraudulent, misleading, abusive, unauthorised, or commercially exploitative purposes.

3. Account Registration and User Information

Certain features of the website may require you to create an account or provide information such as your name, mobile number, email address, billing address, delivery address, GST details where applicable, payment information, product preferences, and service requirements. You agree to provide accurate, complete, current, and truthful information at all times. Garuda will not be responsible for failed deliveries, delayed support, incorrect billing, failed communication, warranty issues, or service limitations arising from incorrect, incomplete, outdated, or misleading information provided by you.

You are responsible for maintaining the confidentiality of your account login details, password, OTPs, device access, and any activity carried out through your account. Any order, enquiry, cancellation, return request, support request, or transaction placed through your account may be treated as authorised by you. 4. Product Information and Representation

Garuda makes reasonable efforts to ensure that product descriptions, images, prices, specifications, dimensions, colours, materials, features, model numbers, brand information, warranty details, offers, and availability displayed on the website are accurate and updated. However, product images are for representation purposes and may vary slightly from the actual product due to lighting, photography, screen settings, packaging changes, manufacturing variations, brand updates, or batch differences.

For electronics and appliances, specifications such as model number, software version, accessories, ports, capacity, energy rating, dimensions, included items, and warranty terms may be updated by the manufacturer from time to time. For furniture, natural variations in colour, grain, polish, texture, cushioning, fabric tone, leatherette finish, wood finish, firmness, or dimensions may occur depending on material type and manufacturing process. Minor variations that do not affect the basic usability of the product shall not be treated as defects.

Customers are advised to carefully review product descriptions, dimensions, compatibility, installation requirements, colour details, warranty conditions, usage instructions, and return eligibility before placing an order.

5. Pricing, Taxes and Offers

All prices displayed on the website are in Indian Rupees unless stated otherwise. Product prices may include or exclude applicable taxes, delivery charges, installation charges, handling charges, convenience fees, payment gateway charges, finance processing fees, packaging charges, extended warranty charges, or other applicable costs depending on the product and order type.

Garuda reserves the right to change prices, discounts, offers, cashback terms, bundled deals, exchange values, finance schemes, promotional campaigns, and product availability at any time without prior notice. A price displayed at one time does not guarantee the same price at a later time. Offers may be valid only for a limited period, selected products, selected brands, selected locations, selected payment modes, selected finance partners, or until stocks last.

In case of a pricing error, typographical error, incorrect discount application, wrong product listing, technical glitch, or system error, Garuda reserves the right to cancel, modify, or reject the order, even after the order has been placed. If payment has already been received for such an order, the eligible refund will be processed as per our Refund Policy.

6. Orders and Order Acceptance

When you place an order on the Garuda website, you may receive an acknowledgement by SMS, email, WhatsApp, website notification, or any other communication channel. This acknowledgement only confirms that your order request has been received. It does not automatically mean that your order has been accepted or confirmed. An order shall be treated as confirmed only after successful payment, stock validation, serviceability check, internal confirmation, and any additional verification that may be required by Garuda.

Garuda reserves the right to accept, reject, cancel, hold, or modify any order due to product unavailability, payment failure, incorrect pricing, suspected fraud, bulk order concerns, resale suspicion, serviceability limitations, address issues, failed verification, or any other valid business reason. For high-value orders, finance-based orders, exchange orders, furniture orders, large appliance orders, customised orders, pre-orders, or bulk orders, Garuda may request additional confirmation, identity verification, payment verification, address verification, or customer consent before processing the order.

7. Payments

Garuda may offer various payment options, including debit cards, credit cards, UPI, net banking, wallets, EMI, buy-now-pay-later options, consumer finance, bank offers, gift cards, store credit, cash on delivery where available, or other approved payment methods. All online payments are processed through authorised payment gateways, banks, card networks, UPI systems, NBFCs, finance providers, or other payment partners.

Garuda does not control bank approvals, payment gateway authorisations, EMI eligibility, card limits, transaction failures, delayed reversals, or third-party payment processing timelines. You agree that any payment method used by you must be valid, authorised, and lawfully used. Garuda shall not be responsible for losses arising from unauthorised use of cards, incorrect payment details, failed transactions, bank downtime, payment gateway downtime, or customer-side payment errors. For EMI, consumer finance, card offers, or buy-now-pay-later purchases, you may be required to separately accept the terms and conditions of the concerned bank, NBFC, finance partner, card issuer, or payment provider. Garuda may assist in facilitating such payment options but does not guarantee finance approval, credit eligibility, interest rates, processing fees, or repayment terms.

8. Delivery

Garuda may deliver products through its own delivery team, logistics partners, courier partners, brand partners, or third-party service providers. Delivery timelines displayed on the website or communicated to you are estimated timelines and may vary due to stock availability, location, route conditions, customer availability, public holidays, weather conditions, traffic restrictions, logistics disruptions, large-item handling requirements, product size, or unforeseen events.

You are responsible for ensuring that the delivery address is accurate, accessible, safe, and serviceable. For furniture, large appliances, televisions, and bulky products, you must ensure adequate lift access, staircase clearance, doorway clearance, parking access, society permissions, floor access, and space for movement and placement. Garuda may not be responsible for failed or delayed delivery where the customer is unavailable, contact details are incorrect, access is restricted, address is incomplete, local permissions are not available, payment is pending, or the product cannot be safely delivered due to site conditions. Additional charges may apply for special handling, long-distance carrying, floor carrying where lift access is unavailable, re-delivery, storage, remote area delivery, or other non-standard delivery requirements.

9. Installation, Assembly and Demonstration

Certain products such as televisions, air conditioners, washing machines, refrigerators, water purifiers, dishwashers, furniture, modular furniture, recliners, beds, wardrobes, desks, and other large products may require installation, assembly, demonstration, or brand-authorised service support. Installation or assembly timelines may differ from delivery timelines and may depend on the brand, technician availability, customer availability, location, product type, and site readiness. Customers are responsible for ensuring that the site is ready for installation or assembly. This may include electrical points, plumbing points, drainage, wall strength, mounting space, ventilation, stabiliser requirements, internet connectivity, civil work, carpentry support, permissions, and adequate working space.

Standard installation, if included, will be limited to the scope specified by Garuda or the concerned brand. Any additional work such as wall mounting brackets, extra pipes, copper wiring, drainage extension, electrical work, plumbing work, carpentry, dismantling of old products, civil modifications, stabilisers, stands, accessories, or non-standard installation may be charged separately. Garuda shall not be responsible for delays, damage, or installation failure caused by improper site conditions, lack of customer readiness, unsafe access, unsupported walls, incorrect electrical points, poor plumbing, customer-requested modifications, or unauthorised third-party installation.

10. Cancellations

Cancellation eligibility depends on the product category, order status, payment status, dispatch status, delivery status, installation status, customisation status, procurement status, and applicable brand or seller terms. You may request cancellation before the order is packed, dispatched, specially procured, customised, installed, assembled, or delivered, subject to Garuda's Cancellation Policy. Certain orders may not be cancellable once processing has started, especially made-to-order furniture, customised products, special procurement products, clearance products, installed products, activated electronics, opened hygiene-sensitive products, or products purchased under specific promotional terms.

Garuda may cancel an order due to stock unavailability, pricing error, payment failure, address unserviceability, suspected fraud, verification failure, resale suspicion, incorrect customer information, or any other valid reason. In such cases, eligible refunds will be processed as per our Refund Policy.

11. Returns, Replacements and Refunds

Returns, replacements, and refunds are governed by Garuda's Returns & Refunds Policy, which forms part of these Terms. Return eligibility may vary based on product category, brand policy, product condition, packaging condition, usage status, installation status, activation status, warranty terms, and the time elapsed from delivery. Products may not be eligible for return if they are used, installed, activated, assembled, damaged, altered, missing accessories, missing original packaging, missing serial numbers, tampered with, stained, scratched, dented, repaired by unauthorised persons, or handled in a manner inconsistent with normal inspection. Furniture, large appliances, televisions, personal care products, opened electronics, customised products, made-to-order products, clearance items, display pieces, and hygiene-sensitive products may have restricted return eligibility.

Any return, replacement, or refund request must be supported by order details, invoice, product images or videos where required, issue description, packaging condition, and any other information reasonably requested by Garuda. If a return or replacement is approved, the product must be returned in the required condition with all accessories, manuals, warranty cards, tags, freebies, invoices, and original packaging wherever applicable. Refunds, where approved, will be processed to the original payment method or any other method permitted by Garuda, subject to applicable deductions, payment gateway timelines, bank timelines, finance partner timelines, and policy conditions.

12. Warranty and Service Support

Products sold by Garuda may be covered by manufacturer warranty, brand warranty, seller warranty, extended warranty, service plan, or no warranty depending on the product category and listing details. Warranty terms are generally governed by the concerned manufacturer, brand, or warranty provider. Garuda may assist customers with warranty guidance, service centre information, installation coordination, and escalation support, but warranty approval, defect verification, repair, replacement, spare parts availability, and final resolution may remain under the control of the concerned manufacturer, brand, authorised service centre, or warranty provider. Warranty may not cover damage caused by misuse, mishandling, accident, liquid damage, voltage fluctuation, unauthorised repair, improper installation, physical damage, cosmetic wear and tear, pest damage, rusting, fabric stains, burns, cuts, scratches, dents, commercial usage, improper cleaning, incorrect assembly, relocation damage, or any exclusion stated by the manufacturer or Garuda. Customers should retain invoices, warranty cards, serial numbers, packaging, product manuals, and service documents for future warranty claims.

13. Exchange Offers and Trade-In Programs

Garuda may offer exchange or trade-in programs for selected products, categories, brands, and locations. Exchange value may depend on the product type, brand, model, age, working condition, physical condition, accessories, market demand, and verification of the old product. The final exchange value may be revised, reduced, or rejected during physical inspection if the condition of the old product does not match the details provided by the customer. Garuda reserves the right to refuse exchange in cases of damaged, non-functional, counterfeit, locked, tampered, stolen, financed, disputed, incomplete, or unverifiable products. By submitting a product for exchange, you confirm that you are the lawful owner of the product and that the product is free from theft, claims, disputes, loans, encumbrances, or third-party rights.

14. Use of the Website

You agree to use the Garuda website only for lawful, personal, and non-commercial purposes unless otherwise approved by Garuda in writing. You must not misuse the website, interfere with its functioning, attempt unauthorised access, upload malicious code, scrape data, copy content, manipulate prices, create fake accounts, misuse offers, submit false information, impersonate another person, abuse customer support staff, post offensive content, or engage in fraudulent activity. You must not use Garuda's website or services for resale, unauthorised commercial procurement, fake order placement, offer abuse, payment fraud, identity misuse, or any activity that may harm Garuda, its customers, partners, employees, systems, or reputation. Garuda reserves the right to suspend accounts, cancel orders, withdraw offers, block users, report illegal activity, or take legal action where misuse is suspected or identified.

15. Reviews, Feedback and User Content

Garuda may allow customers to submit ratings, reviews, comments, photographs, videos, suggestions, testimonials, service feedback, or other content on the website, social media pages, or customer communication channels. By submitting such content, you grant Garuda a non-exclusive, royalty-free, worldwide right to use, reproduce, edit, publish, display, distribute, and promote such content for business, marketing, customer engagement, service improvement, and promotional purposes. You agree not to submit content that is false, misleading, defamatory, abusive, obscene, discriminatory, threatening, unlawful, promotional, spam-like, infringing, or unrelated to your actual product or service experience. All content on the Garuda website, including the brand name, logo, design, layout, text, graphics, images, videos, product presentation, icons, software, catalogues, banners, promotional material, and user interface, is owned by or licensed to Garuda unless otherwise stated. You may not copy, reproduce, modify, sell, publish, distribute, mirror, scrape, download, exploit, or commercially use any content from the website without prior written permission from Garuda. Garuda may collect, use, store, process, and share customer information for account creation, order processing, payment, delivery, installation, warranty support, service assistance, customer communication, marketing communication, fraud prevention, legal compliance, analytics, and service improvement. 19. Availability of Website and Services

Garuda makes reasonable efforts to keep the website and services available. However, we do not guarantee uninterrupted, error-free, secure, or continuous access to the website. The website may be unavailable or interrupted due to maintenance, updates, technical issues, internet failures, payment gateway downtime, cyber incidents, server downtime, third-party service disruptions, or events beyond our control. 20. Limitation of Liability

Garuda's liability, if any, shall be limited to the value of the product or service purchased by the customer in relation to the specific claim, subject to applicable law and policy terms. Nothing in these Terms shall limit any rights available to customers under applicable consumer protection laws.

21. Indemnity

You agree to indemnify and hold harmless Garuda International Electronics Private Limited, its directors, officers, employees, affiliates, partners, agents, service providers, and representatives from any claims, losses, liabilities, damages, penalties, costs, or expenses arising from your misuse of the website, breach of these Terms, violation of applicable law, fraudulent activity, infringement of third-party rights, misuse of offers, unauthorised account activity, or false information provided by you.

22. Force Majeure

Garuda shall not be responsible for any delay, failure, or inability to perform its obligations due to events beyond its reasonable control, including natural disasters, floods, fire, strikes, labour issues, transport disruptions, pandemic, epidemic, government restrictions, war, civil unrest, public emergencies, internet failure, cyber incidents, payment gateway downtime, supplier delays, brand-level shortages, logistics interruptions, or any other force majeure event.

23. Changes to These Terms

Garuda may update, modify, replace, or withdraw these Terms at any time. Updated Terms will be posted on this page with the revised effective date. Your continued use of the website after any changes are posted will mean that you accept the updated Terms. Customers are encouraged to review this page periodically.

25. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.
